The Quest for Meaning Henry Stubbes was credited to have first coined the term "semeiotics" when he identified it as a branch of medical science that interpret signs (Bhaduri, 2008, pp.246). John Locke also referred to the terms semeiotike and semeiotics when he explained his notion about the branches of science. He stated: All that can fall within the compass of human understanding, being either, first, the nature of things, as they are in themselves, their relations, and their manner of operation: or, secondly, that which man himself ought to do, as a rational and voluntary agent, for the attainment of any end, especially happiness: or, thirdly, the ways and means whereby the knowledge of both the one and the other of these is attained and communicated; I think science may be divided properly into these three sorts (Locke, 1823, pp.174). It was Locke’s third branch, where he mentioned semiotics as one of those part of exact knowledge. The work of Charles Pierce and later on Ferdinand de Saussure, however, established the modern notion of the discipline. Pierce referred to the concept of semiotic as a quasi-necessary or formal doctrine of signs. His position on signs is based on his three classifications of its dimensions: icons, indices and symbols (Rahmann, 2001, pp.4). Saussure contributed to the semiotic thought through his discourse of his version of semiotics, which he called as semiology. In 1915, he declared that: A science that studies the life of signs within society is conceivable; it would be a part of social psychology and consequently of general psychology; I shall call it Semiology. Semiology would show what constitutes signs, what laws govern them†¦ Linguistics is only a part of the general science of semio logy; the laws discovered by semiology will be applicable to linguistics (cited in Rahmann, pp.3) Today, adherents of semiotics consider, interpret, classify and analyze signs according to the manner of transmission. The code is a crucial variable in this process because it is the means by which meaning is understood. A new word, for example could easily be coined. Saussure did this with his â€Å"semiology† term. The act alone did not ensure that meaning is transmitted. First, the word must be recognized by the society. Then, it must be transmitted according to the grammatical structures and codes of such society. This is the general framework that underpins semiotics. In the present language, semiology is semiotics. Let us consider the case of a poem. It is an example of a semiotic system because it is consisted of signs in the form of content or rhythm, wherein each constitute a term and a concept not unlike the sensation that one will experience with the aesthetics of the figure of speech. One can also cite the case of a song. Say, in Kenny Loggins’ song Footloose: the lyrics is the message, the score becomes a text and the device where these are communicated could be a digital music player. In the case of the global oxygen cycle, enough carbon dioxide should be available in order for plants to continuously perform photosynthesis that will generate simple sugars such as glucose and the essential atmospheric gas oxygen (Cloud and Gibor, 1970). As for the case of the carbon cycle, it is also necessary the ample oxygen gas be present at all times, which in turns originates from the oxygen cycle, in order for this cycle to proceed. Should there be a situation wherein carbon dioxide or oxygen is insufficient in the atmosphere, the other biogeochemical cycle is affected and may possibly be prevented from completing the reaction. Comparing the Stars of Bright Star and Choose Something Like a Star Keats "Bright Star" and Frost's "Choose Something Like a Star" although similar in their address to a star differ in form, tone and theme. The latter contains an illusion to the former that brings Keats' themes into the poem. In order to compare these poems it is necessary to look carefully at their themes and constructions. "Bright Star" is a sonnet in traditional iambic pentameter. Its tone is elegiac as it celebrates the woman's beauty and his love for her in his plea for steadfastness. The poem opens with an apostrophe to the star which calls our attention to his plea. The verbs "would" and "were" indicate his wish to be like the star whom he addresses as "thou." The star is "hung" in the night, a pleasant image, and he uses a simile to compare it with Eremite, a hermit, who presumably sat apart from the world watching. The eyelids of this star (the star is given anthropomorphic qualities) are eternally apart -- always watching, "patiently" and "sleeplessly." Keats then enumerate s what this star watches. It watches water -- which is also steadfast as indicated by the comparison "priest-like." The waters that surround the land Keats says are performing ablutions or cleansings and blessings on the land. The star also gazes upon the snow. He uses the metaphor of snow as a "mask" (more personification) as it hides the mountains and moors. The "m" alliteration emphasizes the falling of the snow. The repetition of "of" underlines the parallel structure and idea of the two scenes the star regards. The rhythm of this 2nd quatrain is slow and peaceful like the scene. Then Keats puts a "No -- " w... ...t not only continues the "poetic tradition" but adds all the depth of meaning of Keats' poem to his own. The star doesn't want much of us -- only to stay above us. He says that "when the mob is swayed" or when social, political, or moral upheaval takes place and the norm is to be radical, the star likes being above it all, condescendingly regarding the earth. When this happens, we should "choose something like a star" and concentrate on it. In the final line the similarity between "stay" and "staid" emphasizes that we must emulate the star in being constant and moderate while society may revolve around us in social or political turmoil. This "staidness" is our key to survival like the stars'. Therefore, one can see that these poems although similar in their title and central image of the star differ in their themes, form and treatment of the author's ideas.

Managers today have to become more effective in leading and managing their employees. They have to start with a new mind set, change their frame of reference, change how they see the world, how they think about people, and how they view management and leadership. This will bring about quantum improvements in their organization. (Covey) Today's authoritarian style puts managers at a higher level of importance than that of his employees, he makes the decision, gives the commands, and workers conf orm and cooperate, perform and contribute as requested to receive the rewards of pay and other benefits. When managers accept that the "old way" of doing things is not fundamentally the right way, and they shift to a new style that puts principle-centered leadership first, a unique relationship will develop. They will see that people have more creative energy, resourcefulness, and initiative to contribute when they feel valued and their accomplishments are valued. When managers begin to work with the whole person and embrace principles of fairness and kindness and make better use of their talents, than people have a sense of doing something that matters, something with meaning. (Covey) In my organization we are fast paced and deadline driven, each of us has to train and depend on our employees decision making process. I know which of my employees can handle which tasks and set goals for each according to their abilities. I usually get them together in a group to discuss wh at our immediate objectives are. I encourage input from every level, including our part time employees, so everyone feels included and when we achieve goals, everyone wins. We monitor our progress, and meet frequently if a problem arises, and are very quick to praise each other when we have moved closer to our goals. I feel including everyone in this process gives everyone a sense of ownership in the organization. My employees want to contribute, they take great pride in helping in the decision making process, their sense of meaning and worth are just as great a reward as any paycheck could be.

The Debate Over Reparations for Slavery The effects of both the transatlantic slave trade and colonialism continue to reverberate today, leading activists, human rights groups and the descendants of victims to demand reparations. The debate over reparations for slavery in the United States dates back  generations, in fact, all the way to the Civil War. Then, Gen. William Tecumseh Sherman recommended that all freedmen should receive 40 acres and a mule. The idea came after talks with African American themselves. However, President Andrew Johnson and the U.S. Congress did not approve of the plan. In the 21st century, not much has changed. The U.S. government and other nations where slavery thrived have yet to compensate the descendants of people in bondage. Still, the call for governments to take action has recently grown louder. In September 2016, a United Nations panel wrote a report that concluded African Americans deserve reparations for enduring centuries of â€Å"racial terrorism.† Made up of human rights lawyers and other experts, the U.N.’s Working Group of Experts on People of African Descent shared its findings with the U.N. Human Rights Council. â€Å"In particular, the legacy of colonial history, enslavement, racial subordination and segregation, racial terrorism and racial inequality in the United States remains a serious challenge, as there has been no real commitment to reparations and to truth and reconciliation for people of African descent,† the report determined. â€Å"Contemporary police killings and the trauma that they create are reminiscent of the past racial terror of lynching.† The panel does not have authority to legislate its findings, but its conclusions certainly give weight to the reparations movement. With this review, get a better idea of what reparations are, why supporters believe they’re needed  and why opponents object to them. Learn how private institutions, such as colleges and corporations, are owning up to their role in slavery, even as the federal government remains silent on the issue. What Are Reparations? When some people hear the term â€Å"reparations,† they think it means that descendants of slaves will receive a large cash payout. While reparations can be distributed in the form of cash, that’s hardly the only form in which they come. The U.N. panel said that reparations can amount to â€Å"a formal apology, health initiatives, educational opportunities ... psychological rehabilitation, technology transfer and financial support, and debt cancellation.† The human rights organization Redress defines reparations as a centuries-long principle of international law â€Å"referring to the obligation of a wrongdoing party to redress the damage caused to the injured party.† In other words, the guilty party must work to eradicate the effects of the wrongdoing as much as possible. In doing so, the party aims to restore a situation to how it likely would have played out had no wrongdoing occurred. Germany has provided restitution to Holocaust victims, but there’s simply no way to compensate for the lives of the six million Jews slaughtering during the genocide. Redress points out that in 2005, the U.N. General Assembly adopted the Basic Principles and Guidelines on the Right to a Remedy and Reparation for Victims of Violations of International Human Rights and Humanitarian Law. These principles serve as a guideline for how reparations can be distributed.  One can also look to history for  examples. Although the descendants of enslaved African Americans have not received reparations, Japanese Americans forced into internment camps by the federal government during World War II have. The Civil Liberties Act of 1988 allowed the U.S. government to pay former internees $20,000. More than 82,000 survivors received restitution. President Ronald Reagan formally apologized to the internees as well. People who oppose reparations for slave descendants argue that African Americans and Japanese American internees differ. While actual survivors of internment were still alive to receive restitution, enslaved blacks are not.    Proponents and Opponents of Reparations The African American community includes both opponents and proponents of reparations. Ta-Nehisi Coates, a journalist for The Atlantic, has surfaced as one of the leading advocates for redress for African Americans. In 2014, he wrote a compelling argument in favor of reparations that catapulted him to international stardom. Walter Williams, an economic professor at George Mason University, is one of the leading foes of reparations. Both men are black. Williams argues that reparations are unnecessary because he contends that African Americans actually benefitted from slavery. Almost every black American’s income is higher as a result of being born in the United States than any country in Africa, Williams told ABC News. Most black Americans are middle-class. But this statement overlooks the fact that African Americans have higher poverty, unemployment and health disparities than other groups. It also overlooks that blacks have far less wealth on average than whites, a disparity that has continued over generations. Moreover, Williams ignores the psychological scars left by slavery and racism, which researchers have linked to higher rates of hypertension and infant mortality for blacks than whites. Reparations advocates argue that redress goes beyond a check. The government can compensate African Americans by investing in their schooling, training and economic empowerment. But Williams asserts that the federal government has already invested trillions to fight poverty. â€Å"We’ve had all kinds of programs trying to address the problems of discrimination,† he said. â€Å"America has gone a long way.† Coates, in contrast, argues that reparations are needed because after the Civil War, African Americans endured a second slavery due to debt peonage, predatory housing practices, Jim Crow and state-sanctioned violence. He also cited an Associated Press investigation about how racism resulted in blacks systematically losing their land since the antebellum period. â€Å"The series documented some 406 victims and 24,000 acres of land valued at tens of millions of dollars,† Coates explained of the investigation. â€Å"The land was taken through means ranging from legal chicanery to terrorism. ‘Some of the land taken from black families has become a country club in Virginia,’ the AP reported, as well as ‘oil fields in Mississippi’ and ‘a baseball spring training facility in Florida.’† Coates also pointed out how those who owned the land black tenant farmers worked often proved unscrupulous and refused to give sharecroppers the money owed to them. To boot, the federal government deprived African Americans of a chance to build up wealth by homeownership due to racist practices.    â€Å"Redlining went beyond FHA-backed loans and spread to the entire mortgage industry, which was already rife with racism, excluding black people from most legitimate means of obtaining a mortgage,† Coates wrote. Most compellingly, Coates notes how enslaved blacks and slavers themselves thought reparations necessary. He describes how in 1783, freedwoman Belinda Royall successfully petitioned the commonwealth of Massachusetts for reparations. In addition, Quakers demanded new converts to make reparations to slaves, and Thomas Jefferson protà ©gà © Edward Coles granted his slaves a plot of land after inheriting them. Similarly, Jefferson’s cousin John Randolph wrote in his will that his older slaves be freed and given 10 acres of land. The reparations blacks received then paled in comparison to how much the South, and by extension  the United States, profited from human trafficking. According to Coates, a third of all white income in the seven cotton states stemmed from slavery. Cotton became one of the country’s top exports, and by 1860, more millionaires per capita called the Mississippi Valley home than any other region in the nation. While Coates is the American most associated with the reparations movement today, he certainly did not start it. In the 20th century, a hodgepodge of Americans backed reparations. They include veteran Walter R. Vaughan, black-nationalist Audley Moore, civil rights activist James Forman and black activist Callie House. In 1987, the group National Coalition of Blacks for Reparations in America formed. And since 1989, Rep. John Conyers (D-Mich.) has repeatedly introduced a bill, HR 40, known as the Commission to Study and Develop Reparation Proposals for African Americans Act. But the bill has never cleared the House, just as Harvard Law School Professor Charles J. Ogletree Jr. has not won any of the reparations claims he’s pursued in court. Aetna, Lehman Brothers, J.P. Morgan Chase, FleetBoston Financial and Brown Williamson Tobacco are among the companies that have been sued for their ties to slavery. But Walter Williams said that corporations aren’t culpable. â€Å"Do corporations have social responsibility?† Williams asked in an opinion column. â€Å"Yes. Nobel laureate professor Milton Friedman put it best in 1970 when he said that in a free society ‘there is one and only one social responsibility of business- to use its resources and engage in activities designed to increase its profits so long as it stays within the rules of the game, which is to say, engages in open and free competition without deception or fraud.’† Some corporations have a different take. How Institutions Have Addressed Slavery Ties Companies such as Aetna have acknowledged profiting from slavery. In 2000, the company apologized for reimbursing slaveholders for the financial losses incurred when their chattel, enslaved men and women, died. Aetna has long acknowledged that for several years shortly after its founding in 1853 that the company may have insured the lives of slaves, the company said in a statement. We express our deep regret over any participation at all in this deplorable practice. Aetna admitted to writing up to a dozen policies insuring the lives of the enslaved. But it said it would not offer reparations. The insurance industry and slavery were extensively entangled. After Aetna apologized for its role in the institution, the California State Legislature required all insurance companies doing business there to search their archives for policies that reimbursed slaveholders. Not long afterward, eight companies provided such records, with three submitting records of having insured slave ships. In 1781, slavers on the ship Zong  threw more than  130 sick slaves overboard to collect insurance money. But Tom Baker, then director of the Insurance Law Center at the University of Connecticut School of Law, told the New York Times in 2002 that he disagreed that insurance companies should be sued for their slavery ties. â€Å"I just have a sense that it’s unfair that a few companies have been singled out when the slave economy was something that the whole society bears some responsibility for,† he said. â€Å"My concern is more that to the extent that there is some moral responsibility, it should not be targeted to just a few people.† Some institutions with ties to the slave trade have tried to make amends for their past. A number of the nation’s oldest universities, among them Princeton, Brown, Harvard, Columbia, Yale, Dartmouth, the University of Pennsylvania and the College of William and Mary, had ties to slavery. Brown University’s Committee on Slavery and Justice found that the school’s founders, the Brown family, owned slaves and participated in the slave trade. Additionally, 30 members of Brown’s governing board owned slaves or helmed slave ships. In response to this finding, Brown said it would expand its Africana studies program, continue to provide technical assistance to historically black colleges and universities, support local public schools and more. Georgetown University is also taking action. The university owned slaves and announced plans to offer reparations. In 1838, the university sold 272 enslaved blacks to eliminate its debt. As a result, it is offering admissions preference to the descendants of those it sold. â€Å"Having this opportunity would be amazing but I also feel as if it’s owed to me and to my family and to others that want that opportunity,† Elizabeth Thomas, a slave descendant, told NPR in 2017. Her mother, Sandra Thomas, said she didn’t think Georgetown’s reparations plan goes far enough, as not every descendant is in a position to attend university. â€Å"What about me?† she asked. â€Å"I dont want to go to school. Im an old lady. What if you don’t have the capacity? You have one student lucky enough to have decent family support system, got the foundation. He can go to Georgetown and he can thrive. He has that ambition. You’ve got this kid over here. He’ll never go to Georgetown or any other school on this planet beyond a certain level. Now, what you going to do for him? Did his ancestors suffer any less? No.† Thomas raises a point on which  both supporters and foes of reparations can agree. No amount of restitution can make up for the injustices suffered.

A guest post for Bookmachine I was invited to guest post for Bookmachine and decided to dig deeper in the point made by Kristine Kathryn Rush that we might be at the end of the indie gold rush, if there ever was one. Here’s to starting the year on a positive note!An ALCS survey in the UK  last summer crystallised industry concerns about whether career authorship is a viable profession these days. The report painted a somewhat grim picture for professional and part-time authors alike–regardless of whether those authors publish traditionally or independently. (For a crash-course on the industry landscape, I recommend Kristine Kathryn Rush’s exhaustive report on â€Å"things indies learned in 2014†.)The question now is, has the indie â€Å"Gold Rush† passed? Is success finite, and has it been mined to depletion?I don’t believe so.In fact, I’m convinced we’ll see many more indie success stories over the next few years–maybe even more than the ones weâ €™ve witnessed so far. The â€Å"Gold Rush† ends when there is no more gold left, or no way to get to it. That’s not the case here. There he rose to be deputy chief-of-staff before being asked, in July 1998, to take charge of one of Russia's new security services, the Federal Security Bureau (FSB), replacing Nikolai Kovalyov. Subsequently, President Boris Yeltsin appointed him as head of the powerful Security Council. After Boris Yeltsin sacked Sergei Stepashin in August 1999, he became Russia's prime minister. On the last day of the 20th century, Boris Yeltsin resigned and appointed him as acting president. Presidential elections were held on March 26, 2000. Putin received 52.94 percent of all votes. In this paper, I will describe Singers objective and give his argument with regards to this issue. I will describe three counter-arguments to Singer’s view which he addresses, and after that reveal Singer’s reactions to those counterarguments. Singer explains, â€Å"In case its in our power to avoid something bad from occurring, without thereby compromising anything of comparable moral significance, we should, morally, to do it (1972). † He thinks that we are able to do whats right however we should decide to do whats right even when everybody else decides not to. Singer also touches on whether our moral responsibilities must be restricted to distance. The counter-argument in this instance proposes that because these suffering people are so far away, why is it my moral responsibility to help them instead of using it in my own area? According to Singer, â€Å"It makes no ethical difference whether the individual I can assist is a neighbors kid 10 yards from me or a Bengali whose name I shall never know, 10,000 miles away (pg. 232). † Its still our moral obligation to do whats right. Is it morally appropriate to discriminate against a suffering individual just due to their distance? Singer suggests, â€Å"In case we accept any rule of impartiality, universalizability, equality, or whatever, we cant discriminate against somebody just because he is far away from us (or we are far off from him) (pg. 232)†. A person’s distance must not restrict our moral duties. Singer believes that everybody must give when its required. Many people are not contributing, so how much must I give without making myself or my loved ones worse off? The counter-argument here is whether to give more than can cause financial stuggle. He discusses the probability of contributing to the point of marginal utility. As Singer states â€Å"Because the situation seems to be that not many people are likely to give considerable sums, it makes sense that I and everybody else in similar conditions must give as much as possible, that is, at least up to the level at which by giving more one would start to cause acute suffering for oneself and one’s dependents-perhaps even beyond this level to the stage of marginal utility, at which by giving more one would cause oneself and one’s loved ones just as much suffering as one would prevent in Bengal† (pg. 234). To conclude, we all must give as much as possible so long as it doesnt cause us to suffer in the process. Singer proposes that responsibility and charity is our ethical duty. We â€Å"ought† to assist unknown people in need of assistance if we are capable to and that it would be morally incorrect not to contribute. We must put on our old clothes instead of purchasing new ones just for the simple truth that you want to be well dressed. Duty and charity change in this future world since in this era, many people wont give up certain luxuries so as to give to other people. Most people are selfish and would prefer to indulge in the finer matters in life rather than worry about contributing their hard earned bucks to other people in need of assistance. List of Resources Introduction Our goal is to commit to institutional control by establishing an organization that is operating in full compliance. Title IX law was passed on June 23, 1972 it was intended to end gender discrimination in education. Title IX offers women an equal athletic opportunity to participate in the sports and this law also applies to all educational programs that receive federal funding, and to all aspects of a schools educational system (Weight Zullo 2015, pg.84). An athletic director must make sure that the athletic department as a whole maintains compliance integrity with Title IX or the school may lose its federal funding as well as be brought up on legal allegations. Understanding Title IX Athletics Compliance Introduction The conduct by a university that violates Title IX is sexual harassment, the failure to provide equal opportunity in athletics, and discrimination based on pregnancy. Title IX is enforced by the U.S. Department of Educations Office for Civil Rights along with several compliance enforcement offices throughout the United States. An Athletic Director must have full understanding of Title IX and the educational institutions role in implementing the law which will make the assessment phase meaningful. According to NCAA Title IX policy any educational intuition that receives federal funding must designate at least one employee to coordinate its efforts to comply and carry out the responsibilities under Title IX law and if an educational intuition does not appoint a Title IX coordinator they are failing to comply with Title IX and may face consequences of noncompliance which can include the possibility of losing federal funding for educational programs. The athletic director can maintain full control of the department when working with Title IX coordinator to stay updated on guidelines or new rule changes to the policy (www.ncaa.org). A. Title IX Coordinator Title IX Coordinator has a responsibility to fully understand Title IX, oversee compliance, development, and implementation of grievance procedures, and the intake, investigation, and resolutions of complaints of noncompliance. The information of Title IX Coordinator must be available to students and employees and this contact information is required on all recruiting materials published by the covered university (www.ncaa.org). III. Participation A. Athletics Team for Purposes of Title IX When assessing compliance in the area of athletics participation, it is first necessary to determine what teams count. The sport test is designed to determine whether programs or activities outside those sponsored by the NCAA such as mens rowing also qualify for inclusion when determining equity. B. Athletics Participant for Title IX Purposes A school must determine what the number of male and female athletics participants. In order to determine whether or not a school provides equivalent athletics benefits and opportunities the Office for Civil Rights (OCR) will review the following laundry list of treatment issues (Weight Zullo 2015, pg.89). Our athletes as well as staff will be advised on all Title IX policies, procedures rules and regulations. A university will not have to worry about any violations of Title IX when they continue to operate within the margins that the percentages of male and female athletes are about the same as the percentages of male and female students enrolled at the school , that the school has a history and a continuing practice of expanding athletic opportunities for female students, and finally even though it is not offering its female students substantially proportionate opportunities to play sports, the school is nonetheless fully meeting female athletes interests and abilities (Weight Zullo 2015, pg.89). Deference should not extend to an opined unpublished agency letter because it does not carry the force of law. [WS1] The United States Department of Educations Office for Civil Rights (OCR) letter presented here should not be awarded deference because the regulation letter argues that the interpretation the language of Title IX is ambiguous. Title IX provides that, no person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program that receives Federal financial assistance. 20 U.S.C. ÂÂ § 1681(a); accord 34 C.F.R. ÂÂ §106.1 (emphasis added). OCR issued their letter challenging the interpretation of language on the basis of sex under Title IX, challenging it on the basis that it is not clear as it relates to gender identity. In support of OCRs letter, respondent proffers the legal standard accorded under Auer v. Robbins. There, the Court afforded controlling deference to an agency letter in form of a legal brief by the Secretary of Labor interpreting the language of regulations with regard to overtime pay under Federal legislation. Auer v. Robbins, 519 U.S. 452, 463 (1997). While Auer accords agencies the highest level of deference when interpreting their own regulations, such deference is only warranted in situations where regulatory language is ambiguous, unless the language is plainly erroneous or inconsistent with regulation. Id; see Chevron, U.S.A., Inc. v. Nat. Resources Def. Council, Inc., 467 U.S. 837, 843 (1984);Mission Group Kansas, Inc. v. Riley, 146 F.3d 775 (10th Cir. 1998; Stinson v. United States, 508 U.S. 36, 45, 113 S.Ct. 1913, 123 L.Ed.2d 598 (1993) (quoting Bowles v. Seminole Rock Sand Co., 325 U.S. 410, 414, 65 S.Ct. 1215, 89 L.Ed. 1700 (1945)). Here, the same level of deference to OCR would be inappropriate because OCR interprets language found under Title IX. Title IX is not an agency regulation, but rather federal law, and deference to an agencys interpretation of its regulation is warranted under Auer v. Robbins only when the regulations language is ambiguous, and that is not the case here. Christensen v. Harris County, 529 U.S. 576, 588 (2000) (emphasis added). As such, giving deference to an agencys interpretation of federal law is unwarranted. II. Language under Title IX is unambiguous and clear in its definition of sex. Title IX is clear as to its language, prohibiting discrimination of the basis of sex. When turning to past precedent, many courts have defined the term sex as the biological sex assigned to the person at birth. Johnston v. Univ. of Pittsburgh of Com. System, 97 F.Supp.3d 657, 670 (W.D.Pa. 2015); Frontiero v. Richardson, 411 U.S. 677, 686, 93 S.Ct. 1764, 36 L.Ed.2d 583 (1973). Here, Title IX is clear in its plain language that sex means to be construed as a persons biological sex rather than the gender they identify with. In fact, Title IX makes no mention at all of gender identity anywhere within its language as to be construed as anything but biological sex. We hold a narrow view of the statutory term sex due to its construction under legislative history. Johnston, 97 F.Supp.3d at 677. Because of prior precedent that holds a narrow meaning to the language under Title IX as it relates to sex, and the lack of reference to a persons perceived gender identity, we have to continue to construe on the basis of sex as meaning a persons biological sex and not gender identity. III. Respondent is not likely not to succeed on the merits because Petitioners restroom policy does not violate Title IX. The District Court did not abuse its discretion denying Petitioners preliminary injunction, because Petitioner had a discretionary right under Title IX to implement its bathroom policy. Schools are allowed to provide separate toilet, locker room, and shower facilities on the basis of sex. 34 C.F.R. ÂÂ §106.33 (emphasis added). They may do this so long as such facilities provided for students of one sex shall be comparable to such facilities provided for students of the other sex. Id. After adopting the restroom policy in dispute, Petitioner installed three single-stall restrooms throughout Gloucester High School. R.21. They also raised doors and walls around the bathroom stalls, and installed partitions between urinals, in an effort to minimize the exposure individuals may experience in restroom facilities. Id. While these new policy measures were put in place, it by no means restricted the very nature of using the restroom facilities, but rather imposed an adherence to using separate facilities that correspond with a persons sex at birth. As such, Respondent was by no means denied the right to use the bathroom, nor was he encouraged or mandated to hold it in, but rather designated a separate restroom facility for convenience. Id. Respondent chose to avoid using the restroom in its entirety while present at school and as a result developed painful urinary infections and discomfort because of that choice. Id. Petitioner had every right under the scope of Title IX to enact its restroom policy, and in doing so, provided all students with an alternative facility that may be used by anyone and everyone, at any time. Its purpose was designed to accommodate everyone, including those, such as Respondent, who suffer from gender identity issues, and therefore Petitioner did not act in violation of Title IX. IV. Petitioners policy does not discriminate because it is within its authority under Title IX. Petitioners policy does not discriminate against Respondent because the plain language of Title IX does not prohibit discrimination on the basis of gender identity. Johnston v. Univ. of Pittsburgh of Com. System, 97 F.Supp.3d 657, 673 (W.D.Pa. 2015). To establish a prima facie case of discrimination under Title IX, Respondent must allege (1) that he was subjected to discrimination in an educational program; (2) that the program receives federal assistance; and (3) that the discrimination was on the basis of sex. Id. at 674; accord Bougher v. Univ. of Pittsburgh, 713 F.Supp. 139, 143-44 (W.D.Pa.1989). Here, Respondent cannot demonstrate that he was discriminated against based on sex. In dissecting the language under Title IX, the phrase on the basis of sex is construed to refer to a persons biological and anatomical sex assigned at birth. Title IX does not prohibit discrimination based on gender identity, nor does it even refer to such language within the legislature. Here, however, there was no discrimination under either light. With regard to Respondents gender identity, Petitioner expressed immediate support when Respondent informed officials that he was transgender from the very beginning. R.11; R.16. Subsequently, school officials immediately changed Respondents name in the official school records and began referring to him using only male pronouns. R.16. Furthermore, Respondent was permitted to use the boys restroom for almost two months before community concerns became vocal. R.17. Here, not only was Petitioner sensitive to Respondents requests and needs, but they were more than accommodating to ensure that Respondent felt comfortable within his educational environment. Petitioners restroom policy took into consideration both community and Respondents concerns. Ultimately, the policys intent is to increase both safety and privacy of all students so everyone feels as comfortable as possible using the restroom facilities. By providing all students with the option of an alternative, private single-stall restroom, the school sought to address everyones concerns of privacy. As such, the policy is, in and of itself, inclusive, not discriminatory, and Respondent cannot state such a claim. V. The restroom policy is motivated by a substantial interest. Petitioners restroom policy is motivated by a substantial interest to increase privacy and safety of all students. Petitioner implemented said restroom policy with the scope of addressing the entire communitys concerns, including Respondents, and provide an alternative solution to the dispute set forth. In Johnston, a transgender university student brought suit against the University of Pittsburgh-Johnstown for his expulsion on the basis of discrimination, following failure to comply with the universitys bathroom policy. Johnston, 97 F.Supp.3d at 664. There, the university argued that the reasoning behind their policy of segregating its bathroom and locker room facilities on the basis of birth sex is substantially related to a sufficiently important government interest.' Johnston, 97 F.Supp.3d 657 at 669; accord Glenn v. Brumby, 663 F.3d 1312, 1316 (11th Cir.2011) (quoting Cleburne v. Cleburne Living Ctr., Inc., 473 U.S. 432, 446-47, 105 S.Ct. 3249, 87 L.Ed.2d 313 (1985)). Further, they reasoned that their policy was needed to ensure the privacy of its students to disrobe and shower outside of the presence of members of the opposite sex, which was widely upheld by courts for this reason. Johnston, 97 F.Supp.3d 657 at 669; see Etsitty v. Utah Transit Auth., 502 F.3d 1215, 1224 (10th Cir.2007). Similarly, here, Petitioner inherently undertakes the administrative duty to protect the safety and privacy interests of all their students as an educational body, particularly here because, the students are minors, rather than adults, as in Johnston. Linnon v. Commonwealth, 287 Va. 92, 752 S.E.2d 822, 826 (2014). For this reason, Petitioner has a substantial interest in protecting the safety and privacy of the minor children in its care. Moreover, all students have the right to privacy proscribed under the Constitution, and collectively, those rights outweigh the interests claimed by Respondent. Lee v. The IQ Debate Essay -- Intelligence

Intelligence can be defined in many different ways. This concept has been the focus of numerous studies and investigations by psychologists and other scientific experts. Intelligence can be the mental ability to reason, plan ahead, understand a wide range of complex issues and learn from past experiences (Gottfredson, 1997). Intelligence is the â€Å"resultant of the process of acquiring, storing in memory, retrieving, combining, comparing, and using in new contexts information and conceptual skills† (Humphreys, 1979) Intelligence is commonly measured through the use of a number of scales and quantitative measures, like the Intelligence Quotient (IQ), developed by Alfred Binet in early 20th century to identify which French children needed more attention from their educators. The use of IQ tests progressively spread to all parts of the world. The use of these tests has raised controversy among psychologists and educators, with supporters of IQ tests assuming that the tests produce measure of genetically transmitted intelligence. On the other hand, critics of the tests have pointed out that IQ test provides a measure that defines intelligence through the use of cultural deterministic concepts. The ethnocentrism embedded in the assumptions of many commentators, has generated into a justification for a number of theoretical approaches, like those by Charles Murray and others (http://news.bbc.co.uk/2/hi/health/850358.stm). The dichotomy between the view that intelligence levels are affected by situational factors and the view that intelligence is genetically transmitted has dominated psychological debates on IQ throughout decades. Myth of the Hacker The 1960s hacker, a term that was originally a referent to a good person with computer wizardry, has come full circle into the 1990s. Through media representations and the formation of hacker icons, modern hackers are mythologized as the good hacker. The original hackers of MIT belonged to a group of privileged individuals; they operated during a time when computers were not a household item. Hacking, for this generation, began as an intellectual pursuit as well as a way to pull elaborate pranks. The progression of hacking was limited because computer networking had not been completely implemented into society. In the 1980s, hackers reidentified and renamed themselves rebels; computer bandits who worked to infiltrate the network. With the advent of 80s hacking, cult icons were created in this seemingly underground group of renegades. Such names as Condor and Pengo became worldwide gurus to aspiring hackers. Such icons have also found their way into mainstream media, namely television and film. The very popular film War Games (1983) became a beacon for many modern day hackers; it considered the inventiveness and connectedness of humans and computers, but also went as far as to show how unsecure the government could be. In War Games it is youth that devours computer knowledge and obtains infiltrating power. This new generation of hackers, who seek to know that which is hidden, is portrayed as a boy. The limits become unbounded; it is not just those who are taught at MIT who can hack. What of those who continue to seek access? The 1990s saw a great consumer demand for hacker narratives. Television shows such as The X-Files position hackers fighting against a well-informed government. The X-Files perpetuates the media myth that hackers are a subculture. These are intelligent men who are outcasts of mainstream society. They form an underground culture hidden from view, continuously weary of government plots. The X-Files series also plays up the role of the hacker as humanitarian. They work to find the truth buried in the network by the government. This role of hacker as humanitarian searching for truth becomes a recurring theme in other films. The 1992 film Sneakers is one example of this hacker narrative. The lead role, played by Robert Redford, has a history as a student when his hacking lands his friend in jail and himself into a new life where he has to change his name. He starts a business which hires itself out and attempts to infiltrate/hack security systems of its client(s). Christian Ethics in A Complex World Essay

In 2002 the book entitled â€Å"Choosing the Good: Christian Ethics in A Complex World† was by Dennis Hollinger was published. It gives an overview of the Christian ethics in today’s complicated world. It is indeed a precious and unique book that assesses the framework and perspective of Christian ethics in relation to social issues. The approach is designed to widen initial ideas about relations among different races, policies, human sexualities, economics and many more. The approach of the author is very unusual that made the book more likeable. Hollinger wanted to connect his beliefs to his readers in a way that he wanted to imply something in choosing to do what is good and right. In every social issue at hand there is always an equivalent step by step framework to be followed. The book’s weakness are the lengthy statements that bores readers easily, It may mislead readers since comprehension may be hard to acquire. It would be better if the author wrote it in a direct to the point manner. There are cases presented in the book that aids readers how to carefully analyze a real life scenario. It would be better for people not to complicate things as it is better if problems are looked down easily. In general the book is awesome since it tackles about foundations of ethical theories. Hollinger outlines much of the essential data needed so that readers will understand the areas of pastoral care, Christian ethics and its interconnection with public policy. An overall generalization is also given to see what does the author wanted to imply in this beautiful book. There were also judgments and ethical commitments presented in the second chapter of the book. The issues involving postmodernity and modernity treatment s discussed. But this is the chapter that lacks focus because vague explanations were given on how the society operates in modernity but does not make t in academics. The enticing part is that third part of the book presents figures about history tht guides readers on deciding in this contemporary world. A survey of recent Christian Ethics by Edward LeRoy is part of the book for readers to see an accurate statistics of the public’s opinion. Biblical ethics is also presented that shows a deeper connection of choosing to do the good things in life. The best reference is still the Holy Scriptures. Talking about culture and its relation to faith is also presented by Hollinger in this book. He cited examples like the delineation of Christ and Culture by Niebuhr and how the church is placed in the center of a more organized society. Christ should still stand up amidst the complexities of things I every culture. As the author concludes the book â€Å"the moral task before the Christian church today is immense. But God has called us, as he called Esther long ago in Persia, to be a divine presence for such a time as this† (Hollinger, 2002). For good to succeed it is our duty to devote our moral commitments against the complex world. It is in humility that people can find goodness and it is God who is the true foundation of everything we do (Hollinger, 2002, p. 272). The book is designed to let readers be aware that choosing good should incorporate a broad and deep understanding of the word goodness. Having reflections on the book made it easier for readers to understand what he is trying to point out. It is recommended to discuss a book like this in the classroom scenario so that all students ma practice the ethics of goodness inside the classroom and spread it outside as they grow. Henry Moore Sculptures

Digging deeper into the meaning of Henry Moor's sculptures Moor's sculptures are exhibited all around the world. In Moor's homeland, the sculptures are exhibited in Eke Botanical Gardens, the natural surroundings of the gardens compliment the sculptures. It feels as if the sculptures are different during the different times of the day. In the morning, when the sculptures are wrapped in mist, or during midday when the blue sky and sunshine makes them shine, or in the evening, when the sculptures absorb the red evening sun.All these different interpretations and perspectives would not be possible to see if the sculptures were in a museum, where no natural light would compliment the sculptures. Moore always manages to draw a connection between the sculptures and the landscape. For example, in the following picture, there is a hole in the sculpture, and when you look through there is an abundance of green, if there was a white wall behind it, the sculpture would not be as impressive. Per sonally, I love the fact that the sculpture is almost one with nature, it really blends into the surroundings.The three main themes around Moor's work were the reclining figure, the mother- child relationship and the embryo-like ‘internal-external' forms idea. Moore was influenced by constructivism and surrealism, this is pulled through by the biomorphic forms that Moore produced and also suggested how the human figure could be fragmented into simple, essential forms. The researchers audio-recorded the interviews and later transcribed the audio recordings. After the interviews, there were debrief sessions involving a psychologist. Data analysis was in two stages. The first stage employed the constant comparative method, which involved coding teams of six members. Each member reviewed transcripts independently and then they later compared their results before coming to a consensus. The second stage involved teams of three members. They used a focused analysis to reanalyze the data. There were ten main codes and eighteen sub-codes. Through the constant comparative method, the researchers analyzed thematic differences between hospitals depending on their performance. They used the ATLAS.TI Scientific Software, version 6.2 to analyze the codes they developed. The study was an exploratory type and therefore it was not possible to generalize the findings. Lower-performing hospitals also lack the ability to organize for PCP follow-up. There was also a risk that the participants may have made misrepresentations during the interviews. The authors concluded that the findings of the study conform to their previous theories about the improvement of the care for patients with AMI. Efficient communication and coordination across different fields is the key to the achievement of high quality discharge.
